Mexico City, December 9 (However).- The Plenary of the Chamber of Deputies approved this Tuesday in general, with 324 votes in favor and 129 against, the opinion by which the General Health Law for the total ban of electronic cigarettes, vapers and other analogous systems or devices.

Likewise, all acts of advertising or propaganda are prohibited, so that electronic cigarettes, vaping devices and other analogous systems or devices are consumed, through any printed, digital, television, radio or any other means of communication.
The health authority may carry out the verification, the application of security measures and the sanitary disposal of electronic cigarettes, vapers and other similar systems or devices. The above, regardless of the actions that correspond to other authorities in their respective sphere of competence.
Morena insists that consumers will not be punished
Pedro Zenteno Santaella, Representative of Morena and president of the Health Commission, highlighted that the purpose of the reform is “to protect children and youth from harmful products” through the absolute prohibition of the production, marketing, import and advertising of vapes and electronic cigarettes.
Opposition parties criticized the reform, alleging the alleged criminalization of electronic cigarette holders. In response to the questions, Zenteno stressed that “we will present a reservation to make it clear that the individual consumer of vaping devices is not penalized, but rather those who acquire them for marketing and profit purposes.”

“The most prohibitionist, authoritarian and absurd reform that this country has seen in decades since it criminalizes acquiring, keeping, storing, transporting, distributing or selling vaping devices with sentences of up to eight years in prison,” said the EMEC member, Irais Reyes de la Torre, who presented a suspensive motion that was rejected by the majority.
The Representative maintained that the ruling will punish more severely anyone who sells a vape pen than anyone who violates a woman, discloses intimate photos of someone else without her consent, carries a prohibited weapon or sells it without a license.
He assured that the total ban on electronic cigarettes will benefit organized crime groups, which will now control the sale of vaping devices. “When they criminalize the entire chain, the market does not disappear: it changes owners and that owner is the illegal market,” he explained.
