Emilio Lozoya Austin, former director of Petróleos Mexicanos (Pemex), is still unable to overthrow the criminal process for the Agronitrogenados case, which is still in force.
And it is that A Collegiate Court denied him protection with which he sought to suspend the accusation made against him by the Attorney General’s Office of the Republic (FGR) for the purchase at a premium of the scrap plant Agronitrogenados to the businessman steelmaker Alonso Ancira Elizondowho received 475 million pesos from the parastatal.
Lozoya Austin seeks to ensure that the matter does not reach the intermediate stage, to prevent the FGR from accusing him of money laundering.
Therefore, in his lawsuit he argued that, in the matter, Ancira Elizondo covered the repair of the damage, a situation that benefits him from making some economic reparation.
However, Ezequiel Altamirano Roches, investigating magistrate, member of the Second Collegiate Court of Appeal in Criminal Matters of the First Circuit, denied granting the protection of justice to the former director of Pemex, stating that he is not right.
The justice provider explained that it is unacceptable to consider that, if one of the co-defendants has already guaranteed the repair of the damage, this benefits the others, since the solidarity of the co-defendants in the repair of the damage cannot be assumed as a general rule.
Furthermore, he indicated that it cannot be stated that the repair of the damage is already guaranteed, because Alonso Ancira has not covered the full payment.
It should be remembered that the businessman promised to pay 216 million dollars, but has only made two payments for approximately 110 million dollars. If you do not cover the full amount, you could go back to jail.
