A bill is currently being discussed in Ohio that would deny artificial intelligence (AI) any personal status. Representative Thaddeus Claggett introduced this bill to ensure that people, companies or developers can be held accountable for the actions of their AI systems. A central goal of the law is to prevent the “It wasn’t me, it was the AI” defense in court.

The draft law stipulates that AI systems will not be allowed to marry, own property or take on decision-making roles in companies. Claggett argues that it is necessary to draw clear legal boundaries between human and artificial consciousness before AI is fully integrated into our everyday lives. He emphasizes that courts must be able to clearly assign responsibility for harm caused by AI to a human actor.

While the bill is viewed by some as overreaching, it also has support from organizations like the Alliance for Secure AI. This praises the law’s liability language as it closes a dangerous loophole that could allow companies to deny responsibility for damage caused by their AI systems. Critics such as the TechNet group, however, warn that the definition of AI in the law is too broad and could lead to legal uncertainty.

The draft has also sparked debate over the definition of “consciousness” and “sentence.” Experts suggest using the term “consciousness” to better capture the ability to make autonomous and reflective decisions. Claggett has announced that it will revise the legal text to clarify the definition of AI and address expert feedback.
