The Attorney General’s Office (PGR) clarified this Monday, October 6, that “no telephone interceptions” were made “under the inquiry instituted to Ivo Rosa in February 2021.
“The steps performed respected all legally established rights, freedoms and guarantees,” says PGR.
This clarification, sent to the newsrooms, arises after an investigation by CNN/TVI revealed that Judge Ivo Rosa was the subject of a criminal case initiated in 2021, months before providing the instructional decision in the case of Operation Marquis. At the time, Rosa dropped the majority of crimes imputed by the Public Prosecution Service to the defendants, including former Prime Minister José Sócrates, a decision that would later be reversed by the Lisbon relationship.
According to the channel, the complaint that was the origin of the inquiry to the judge pointed to suspicions of corruption, embezzlement and laundering of capital, but was classified by the Assistant Attorney General as containing “inconsistencies”. The process would end up filed in March 2024.
The PGR said that the steps carried out were submitted to “prior judicial authorization and/or validated by judge in all cases provided for by law”.
“In this investigation, the Public Prosecution Service was assisted by the Judicial Police. The evidence, once collected, was lacking analysis,” the note adds.
