Mexico City. – The president of the Supreme Court of Justice of the Nation (SCJN), Hugo Aguilarpresented a project to review the protections that were rejected by the previous Court on the Electrical Industry Law promoted by former president Andrés Manuel López Obrador. However, the rest of the ministers in the plenary session rejected the initiative that sought to modify the sentences issued by previous ministers.
The minister president presented his project as an appeal. In the case of amparo, the vote given by the then minister Alberto Pérez Dayán, broke a tie that prevented the discussion of the Electrical Reform. The argument of Hugo Aguilar To return to the case was “what I am putting on the table, what I emphasize, is that, in the previous integration, in this case of the Second Chamber, they deviated from the legal mandate to cast a quality vote that defined a law of great importance in the public life of our country.”
The judges of the SCJN They rejected their project since they considered it to be a collegiate ruling and not the agreement of the then president.
Among the arguments of ministers such as Giovanni Figueroa Mejía, he pointed out that resuming a case that has already been resolved violated the constitutional principles of legal certainty and res judicata.
While Lenia Batres warned that if we had accepted the project, “we would be opening the possibility that the voting processes of this collegiate body could be challenged in all matters. The appeal is essential, since it is a means designed in the law to agree on procedures, but not to challenge votes of the judging people.”
