On the afternoon of November 4, Claudia Sheinbaum was on a tour to the facilities of the Ministry of Public Education (SEP) when She was surprised by a man identified as Uriel “N”. In the videos broadcast on social networks, it is observed that the subject approached her without authorization, hugged her from behind and tried to kiss her on the neck.

What penalty does the law establish?
Article 176 of the Penal Code of Mexico City classifies as sexual abuse any act of sexual connotation executed without consent and without the intention of reaching copulationimposing a sentence of one to six years in prison and a financial fine. If physical or moral violence is used, the penalty increases by half.
Article 177 increases the penalty from two to seven years when the victim cannot resist or understand the incident, while article 178 adds aggravating factors if the crime occurs in public spaces or involves a public servant, which can lead to up to ten years in prison.

As of the reform published on March 20, 2020, article 178 Bis provides that any person sentenced for these crimes will be registered in the Public Registry of Sexual Offenders as measure of protection for the community, except for cases that are pursued by complaint.
