MUNICH / LONDON (IT BOLTWISE) – A groundbreaking ruling by the Munich Regional Court has strengthened GEMA’s rights in the dispute with OpenAI. The company is not allowed to use song lyrics to train its AI models without a license. This ruling could have far-reaching consequences for the licensing practices of AI companies.

The Munich Regional Court has ruled in a significant ruling that OpenAI violated the copyrights of song writers when training its AI chatbot ChatGPT. GEMA, a collecting society, had filed a lawsuit against OpenAI because the company had used song lyrics for AI training without the appropriate licenses. The court mostly agreed with GEMA and found that OpenAI had violated the exploitation rights of the rights holders. This allows GEMA to demand injunctive relief, information and compensation.
The court’s decision could serve as a precedent for similar cases in Europe, as it is the first ruling of its kind. The judges emphasized that the Internet is not a self-service shop and that human creative achievements cannot be used as a free template. The use of song lyrics for AI training is not covered by any restrictions, especially not by the restrictions on text and data mining.
In the USA, on the other hand, there is the so-called “fair use” doctrine, which allows a consideration based on various criteria as to whether the use of copyrighted material without compensation is permitted. These differences in legal assessment could lead to different outcomes in similar cases. There are already numerous copyright lawsuits pending against tech companies in the USA regarding the use of copyrighted material for AI training.
The Munich court’s decision could increase pressure on politicians to create clear regulations for the licensing of AI training data. Federal Minister of Justice Stefanie Hubig emphasized the need to improve the situation for authors and, if necessary, discuss legal adjustments at EU level. However, experts warn against overestimating the significance of the ruling, as only further court cases in Europe and the USA will determine the future freedom of AI models.
