The first judicial attack against Grupo Elektra It started in 2020 when the Tax Administration Service (SAT) revealed that after investigations carried out on the payment of Income Taxes (ISR), Elektra owed the federation an initial amount of 18,455 million pesos corresponding to the year 2013. Federal authorities confirmed that the growth of the debt was due to the fact that time generated interest and allowed more unpaid taxes to be confirmed in the years 2008, 2009 and 2012.
In this case, one of the last projects left by the previous SCJN at the end of 2024, even without ministers elected by popular vote, was to allow it to suspend litigation against Ricardo Salinas’ companies, so that these matters can be resolved by the new judges.
In June of this year, the Second Collegiate Court on Administrative Matters of the First Circuit resolved a new trial in which it determined that Grupo Elektra had to pay 2 billion pesos corresponding to unpaid taxes in 2010, a matter that was under discussion and unconfirmed due to the protections during the last three years.
This last resolution confirmed a tax debt of 31,800 million pesos, however, the figure could increase in the coming months because the matter that the previous SCJN delegated over the Salinas Pliego companies is pending.
