Denmark, as President of the European Council, has withdrawn its proposal to introduce so-called chat controls. This measure would have required platforms such as Telegram, WhatsApp and Signal to scan messages before encrypting them. The proposal, first presented in May 2022, aimed to combat the spread of illegal content via messaging services. But critics argued that this would undermine encryption and endanger the right to privacy.

Danish Justice Minister Peter Hummelgaard said the proposal will not be part of the EU presidency’s new compromise proposal and that whether tech giants scan encrypted messages will remain voluntary. The decision was welcomed by privacy advocates and tech companies alike, who see the withdrawal as a victory for digital freedoms in the EU.

The current voluntary regulation expires in April 2026. If no agreement is reached by then, the EU could be left without legal means to combat abuse of messaging services. The withdrawal of the proposal is intended to ensure that a new framework can be put in place before the deadline.

Tech companies and privacy organizations such as the Electronic Frontier Foundation have hailed the decision as an important step against mass surveillance. They emphasize that privacy protection and the security of encryption technologies should not be sacrificed. However, the discussion about the right balance between security and data protection will continue, especially as Ireland takes over the EU Council Presidency in July 2026.
