The German federal government has presented an ambitious reform package that is intended to significantly accelerate the modernization of the country’s infrastructure. The focus is on the draft of an ‘Infrastructure Future Act’, which aims to simplify and digitize the lengthy planning and approval procedures. This initiative is in line with the coalition agreement and is currently being coordinated within the government.

A central concern of the law is the designation of projects as being of ‘overriding public interest’. This classification, which was previously limited to the rail network and selected motorway projects, is now to be expanded to include other transport projects. The aim is to strengthen mobility, security of supply and national competitiveness.

In order to speed up the planning processes, the draft provides for the abolition of double checks in spatial planning and line determination procedures. In addition, planning approval procedures should be handled completely digitally in the future in order to avoid unnecessary paperwork. These measures are intended not only to speed up implementation, but also to prevent inflation-related cost increases in large transport projects.

Environmental protection remains an important aspect of the law. The regulations should be designed to be uniform and practical across the country. The right of environmental associations to sue remains unchanged, but the conditions for their recognition are to be limited in future. Future legal proceedings should be clearly defined in order to avoid endless rounds of lawsuits.
