The Investigation Commission of the Judicial Disciplinary Court, chaired by Judge Bernardo Batizyesterday suspended a district judge based in Colima, for a “notorious deviation from legality.” The measure was taken after the judge reduced sentences in at least four cases related to crimes of carrying and possession of firearms, as well as narcotics.
In a statement, The Court noted that the judge did not act as a guarantor of compliance with the legal requirements, but instead maintained repeated and systematic conduct that exceeded his powers and contravened guiding principles of criminal procedure.
Their actions, the bulletin indicated, violated the provisions of sections II and IX of article 187 of the Organic Law of the Judicial Branch of the Federation. For this reason, the Investigation Commission determined the suspension to prevent it from continuing to jeopardize the correct administration of justice.
The judge was notified of the provisional suspension in order to prevent concealment or destruction of evidence. The statement detailed that it repeatedly reduced the sentences agreed upon between the Prosecutor’s Office and the defendants who opted for the abbreviated procedure, acts that were corrected by higher courts as they were considered contrary to the law.
He also granted benefits of a conditional sentence, violating due process and without fully complying with the requirements to initiate abbreviated procedures.
