La Jueza Gabriela Villeda determinó que el bebé abandonado por sus padres el pasado 11 de febrero en Tultitlán, Estado de México, será dado en adopción.


The minor’s parents were located a short time later by the authorities and were placed at the disposal of a Public Ministry to establish criminal responsibilities for the abandonment.

Mexico City, November 29 (However).- The federal judge district, Gabriela Villedadetermined that the abandoned baby by his parents the past February 11 on a street in the municipality of Tultitlan, State of Mexicowill be given in adoption to a family that seeks the well-being of the minor.

“Our interest is that he is well, that he has the right to love, to a family,” highlighted the judge.

The baby remains in the custody of the System for the Comprehensive Development of the Family of the State of Mexico (DIFEM), while Lucio “N”, 18 years old, and Diana “N”, 21 years old, parents of the minor, are subject to criminal proceedings for the crime of attempted homicide for which they remain in preventive detention.

After the case went viral, the paternal and maternal grandmothers stated that they would seek custody of the minor. His paternal grandmother went to visit him on May 15 at a temporary assistance center. Later, the Judge assigned her a time and date to visit her grandson, but she did not show up.

For this reason, the DIFEM authorities maintained custody of the newborn who already has a name and the surnames of the father and mother, although these may change when it is adopted. Currently the minor is in the DIF of Toluca where he will wait for a family that will adopt him.

On February 11 of this year, Lucio “N” and Diana “N” abandoned their son on Fuente de Ópalo Street, in the Fuentes del Valle neighborhood, in Tultitlán.

In a video that went viral on social networks you can see the moment when Lucio “N” approaches the front of a house and leaves a black bag inside which his son was. The 18-year-old did not notice the camera that recorded the crime and continued on his way. Shortly after, the parents were apprehended by the authorities.

That same day, the baby was transferred to the Bicentenario de la Independencia hospital, belonging to the Institute of Security and Social Services of State Workers (ISSSTE), as reported by its general director, Martí Batres Guadarrama.

In his statement, Lucio “N” said that on Tuesday, February 11, his partner reported feeling sick to his stomach after taking abortion pills. After the discomfort, Diana “N” gave birth at her workplace without anyone noticing and asked her partner to take her and leave her to her fate.
