TDJ disqualifies and dismisses magistrates for sexual misconduct against subordinates


The Disciplinary Commission of the Judicial Disciplinary Court of the Federal Judicial Branch (TDJ) has held an average of 20 administrative liability procedures against federal judges and magistrates of the Mexico City and of Guerrero, Monterrey, Chihuahua, Colima, Jalisco, Morelos, Zacatecas, Tamaulipas, Tabasco and Sinaloa.

Rufino H León Tovar, presiding judge of the Disciplinary Commission, mentioned that these are procedures generally initiated by complaints from the parties in the trials that are processed before Courts and Collegiate Tribunals of the Federationwho allege alleged deficiencies in the administration of justice; but procedures initiated were also resolved for mistreatment of staff and for improper conduct by judges against women.

A case stands out in which a judge from Morelos incurred alleged sexual harassment between the months of November 2023 and until July 24, 2024, through innuendos and comments of a sexual natureas well asunwanted enclosures and touching to the detriment of five public servants; even reaching the point of having sexual relations with one of the victims in his office.

Considering that these are behaviors that were carried out through a plurality of actions and taking advantage of the circumstances of hierarchical position and place that allowed the aforementioned Judge to hold office, the Disciplinary Commission determined to impose as a sanction the disqualification to perform jobs, positions or commissions in the public service for one year, leaving safe the rights of injured public servants to report the facts to the Public Ministry.

In another case, it was learned that between January 21 and April 30, a magistrate assigned to the state of Tabasco made sexual advances and requested sexual favors against the complainant in exchange for appointments, until he managed to impose copulation on her.

In this matter, the evaluation of evidence made it possible to establish that the accused engaged in sexual harassment by taking advantage of his hierarchical position and affecting the dignity of the victim, which is why it was decided to remove him from office.

They denounce hostile environments

A Judge from Zacatecas between the months of November 2021 and April 2024, engaged in professional mistreatment with three people who were under her direction, generating a hostile environment and rivalry between those who were under her command; The aforementioned administration of justice, due to its poor work organization, caused excessive and systematic work hours, forcing staff to stay to work until late at night on a recurring basis and despite this, it maintained a notable delay and did not issue resolutions within the deadlines established in the law without valid justification for it.

Due to the above, He was disqualified for three months from holding jobs, positions or commissions in the public service.

The president of the Disciplinary Commission maintained that any judge in the country who, in the exercise of his or her duties, engages in these or other practices that harm the Judicial Branch of the Federation, will be sanctioned, regardless of position or hierarchical level.
