A small startup from Schleswig-Holstein recently won a significant legal battle that caught the attention of the entire spirits industry. The company is allowed to continue to sell its vegan liqueur, which is made from soy, under the name “Egg-free liqueur”. This decision came after the spirits industry protection association sued because it feared a misleading association with eggnog.

The case was heard at the Kiel Regional Court, where the protection association argued that the name of the product violated the EU Spirits Regulation. The association, whose chairman is the managing director of the well-known eggnog manufacturer Verpoorten, saw the name as an inadmissible allusion to eggnog that could mislead consumers. However, the court rejected this argument, noting that the name “egg-free liqueur” clearly indicates that it does not contain eggs.

The court’s decision could have far-reaching implications for the labeling of vegan and vegetarian products. There have been discussions in the past about how such products should be named, especially when they use traditional names that typically include animal products. The EU Parliament recently decided that vegetarian and vegan meat substitute products can no longer be called “schnitzel” or “sausage”, which shows how controversial this issue is.

For the startup, the ruling not only represents a legal victory, but also confirmation of its innovative marketing strategy. The company originally issued a cease-and-desist notice after advertising the product as “egg-free eggnog” and was fined for it. But the current decision allows the company to continue marketing its vegan spirit under the new name, which can be seen as a victory for the creativity and adaptability of smaller companies in a highly regulated market.
