The Superior Chamber of the Electoral Court determined that the ministers Yasmín Esquivel and Sara Irene Herrerías did not commit infractions for the alleged dissemination of accordions as propaganda during the closed period of the judicial election.
He also revoked fines from Bernardo Bátizmember of the Judicial Disciplinary Court, due to irregularities detected in the consolidated expense report of the judicial election campaign period.
The above was approved by a majority, with the excuse of Judge Gilberto Bátiz and Judge Claudia Valle, who requested to be absent for having participated in said election.
In a first matter, it resolved that the infractions for the possible preparation, production and distribution of propaganda during the closed period and on election day, attributed to the ministers Yasmín Esquivel and Irene Herrerías, among others, do not exist.
Also It was rejected that they had violated the principles of equity and legality in the contest, coercion and induction to vote derived from the alleged dissemination of accordions in the state of Chiapas.
The Court held that it was not proven that the propaganda identified as an accordion was produced or distributed by the denounced persons.added to the fact that the circumstances of manner, time and place were not proven.
Nor was there evidence of any delivery of a gift or promise that sought to exert any pressure on the electorate.
He pointed out that only the existence of the links referred to in the reported propaganda was verified, without having any evidence that said material was distributed during the electoral ban period and on the day.
Besides, The coercion to vote was not proven, as well as the violation of the closed period Therefore, the undue benefit and violation of the denounced principles are not proven either.
