After the resignation of prosecutor Alejandro Gertz Manero, there are many voices that point to opacity in his management, among them from human rights organizations. In a joint statement, this is their opinion on the official’s rapid departure:
At least 50 human rights organizations disapproved of Alejandro Gertz Manero’s withdrawal from the Attorney General’s Office (FGR) in a process without transparency, with multiple doubts and questions and without having been held accountable for his management..
“Gertz Manero’s letter was not a formal resignation nor did it comply with the constitutional requirements, yet the Senate approved his separation despite not having expressed a serious cause, as established by the Constitution”noted organizations such as the Foundation for Justice.

Through a statement, they indicated that the lack of transparency of the authorities regarding the true reasons for the separation of Gertz Manero, “are an example of opaque managementcharacterized by authoritarian action and an absolute absence of accountability to citizens.”
They accused that the prosecutor’s offices in Mexico have been used, by the governments in power, as an instrument of political control, to combat adversaries or to guarantee pacts of impunity to the detriment of society
They stated that the prosecutor’s offices do not diligently investigate or guarantee justice to the victims; on the contrary, they re-victimize them and often inhibit the filing of complaints.either intentionally or out of fear that public ministries or investigative police have criminal ties that expose them to greater risks.

“The express handling of Gertz Manero’s resignation shows that the Executive Branch and the 4T want to continue having political control over the prosecutor’s office. Just look at how they operated in record time, the resignation of the Legal Counsel, her appointment by Gertz Manero and her appointment as head of the FGR office”they recriminated.
They demand a serious process from the Senate
So, They demanded that the Senate of the Republic guarantee a serious process, and with the required times, of public selection, open, transparent and with citizen participation mechanisms to designate the new head of the FGR.; that takes up international standards to define the ideal profile that candidates must cover, the characteristics to be evaluated and an objective methodology that includes public interviews and true public scrutiny.
They asked that the Senate ask the candidates for a work plan to restructure the FGR according to the great challenges that the institution presents, such as eliminating corruption and impunity, especially in cases that most affect society; strengthen institutional capacities and improve investigations into crimes within its jurisdiction and the serious contexts of high crime in the country, putting victims at the center.

“That the new head of the FGR open public calls to fill the new positions of specialized prosecutors and other relevant positions in the institution.which contain requirements to analyze the suitability of candidates, mainly in the prosecutor’s offices for human rights, organized crime, regional control and electoral crimes,” the document says.

Hours later, the Senate of the Republic received a communication from the former attorney general, Gertz Manero in which he reported that He had been invited by President Claudia Sheinbaum as Ambassador of Mexico to a friendly country and that he was “retiring” from the position of Attorney General.

During the last six years, in the collective against Impunidemia we publicly expressed a series of serious deficiencies in the management of prosecutor Gertz Manero and sustained setbacks in the FGR in terms of transparency, accountability and citizen participation mechanisms,” they explained.
They ask for a profound change
Human rights organizations mentioned that they have demanded from all governments a profound and radical change in the prosecutor’s offices.which guarantees its autonomy from political power and factual powers. In response, they pointed out, a judicial reform was imposed that did not affect the prosecutor’s offices, but rather politicized the positions of judging persons – judges, magistrates and ministers – under the protection of a “popular” election.
“We all want there to be greater coordination between security and justice institutions, but not sacrificing the autonomy of the prosecutor’s office or to guarantee impunity pacts, but rather to investigate, prove criminal responsibility with solid evidence, combat crime, reduce violence and impunity for crimes in the country,” they indicated.
