In Berlin, Germany’s export policy of military equipment to Israel is being put to the test. Two lawsuits before the Berlin Administrative Court raise the question of whether these exports are compatible with Germany’s obligations under international law. The plaintiffs, including a senior doctor from Berlin and his father from Gaza, are calling for a ban on arms deliveries as long as hostilities are taking place in Israel. They argue that German practice violates international agreements.

Another case concerns four Palestinians from the Gaza Strip who are demanding the cancellation of a permit for 3,000 anti-tank weapons. One of the plaintiffs has since died, but the remaining parties are seeking a ruling that would classify the export as unlawful. These cases could have far-reaching consequences for German arms export policy.

The discussions about German arms exports received new impetus from the Hamas terrorist attack on October 7, 2023. In response, the federal government significantly increased deliveries to Israel. But in August, Chancellor Friedrich Merz stopped the export of arms that could be used in the Gaza conflict. Despite these measures, arms transfers worth at least 2.46 million euros were approved in September.

These developments highlight the complex political and ethical issues surrounding arms exports. While the German government emphasizes the need to support Israel, critics are calling for stricter control and compliance with international standards. The Berlin court’s upcoming decision could therefore not only influence current policy, but also shape future export practices.
