Apple has expressed concern about the EU’s new digital competition rules in an open letter to the European Commission. The company argues that regulations forcing it to allow smaller competitors into its app store make the platform less safe for consumers. According to Apple, the risks to users on their devices will inevitably increase.
Apple Vice President Kyle Andeer emphasizes in the letter that the EU is pursuing an “enforcement agenda” aimed at undermining the security and privacy of iOS and iPadOS. This is the latest complaint from an American company about the alleged overreach of the EU’s powerful digital laws.
The tensions have also impacted trade negotiations between the US and the EU. President Trump in August threatened higher tariffs on countries with technology rules he sees as discriminatory against U.S. companies. In an opinion piece in April, Trump’s trade adviser Peter Navarro accused the EU of waging “legal warfare” to target “America’s biggest tech companies.”
In recent years, the EU has passed two important laws for online platforms. The Digital Services Act requires platforms to comply with certain rules on illegal or harmful content and advertising to minors, while the Digital Markets Act aims to promote online competition. Technology companies face heavy fines if they violate either law.
Apple was fined €500 million in April for allegedly violating the EU’s Digital Markets Act by preventing app developers from pointing users to alternatives to the App Store. Apple appealed the fine. Since then, the company has stepped up claims that EU rules have opened the door to financial fraud, pornography, privacy issues and other problems.
In its new letter, Apple explains that the European Commission sent a request in October asking whether the tech company had taken measures to ensure a high level of security for minors under the Digital Services Act. Apple countered that the EU’s other major law, the Digital Markets Act, requires developers to be able to link to websites and other apps from their apps “without meaningful safeguards.”
This exposes users to scams and scams on these third-party platforms that Apple cannot control or monitor, even for apps distributed through the App Store. Apple has repeatedly warned the Commission that its approach to enforcing the DMA is reckless and even dangerous, and called on the Commission to address the new risks its approach has created for consumers.
American tech giants such as Apple, Meta and Google are under scrutiny on both sides of the Atlantic as regulators accuse them of stifling competition. In addition to the fines in Europe, U.S. authorities sued Apple last year, claiming the company violated federal antitrust laws by imposing “variable rules and restrictions in its App Store policies.”
